On March the 20th, Nintendo released a press release regarding their ongoing patent dispute with Tomita Technologies USA. The United States Appeals Court confirms that Nintendo’s 3DS handheld console does not use technology that has been covered by a patent held by Tomita Technologies USA. The Court determined that the Nintendo 3DS uses technology that is significantly different from the associated patented technology. The ruling comes after Judge Jed Rakoff ruled in April of 2016 that Nintendo had not infringed on the patent.

The dual rulings vindicate Nintendo, which has remained adamant that their technology did not infringe on Tomita Technologies patents for the past six years. Tomita also attempted to enforce a very similar patent claim in the country of Japan. That attempt also fell through.
