Last week, it was announced that 64-year-old Dr. Andres Mencia of Fort Lauderdale, Florida had been convicted for participating in a conspiracy to distribute a controlled substance. Evidence admitted at trial showed that the defendant ran Adult & Geriatric Institute of Florida, which was doing business as AGI Medical & Dental in Oakland Park, Florida. Around January of 2014 and continuing through October of 2017, the defendant and his office personnel Oscar Luis Ventura Rodriguez, Nadira Sampath-Grant and John Mensah conspired to perform sham consultations with cash-paying patients.
Evidence showed that the real purpose of the consultations was to improperly issue the patients with prescriptions for opioids and narcotics in exchange for cash payments. Mencia instructed the co-conspirators to keep track of the drug-seeking patients by identifying them as “CS” or controlled substance patients. Occasionally, the defendant provided his co-conspirators with pre-signed prescriptions.
During the scheme, Mencia was not providing a medically meaningful consultation. Instead, he was acting outside the scope of his professional practice and without legitimate medical purpose.
