This week, it was announced that 41-year-old Lavyette Garcia of Johnson City, New York had been sentenced to 24 months in prison. She has also been ordered to pay $72,452 in restitution to the United States Treasury Department. The sentencing comes after Garcia pleaded guilty to preparing false federal income tax returns and making false claims against the United States government. Garcia was arrested by special agents of the IRS-CI at her home in Johnson City on November 17, 2017.
By admitting her guilt, the defendant acknowledged that from 2011 to 2014 she knowingly and intentionally prepared and filed 110 false federal income tax returns. The false returns contained fictitious income levels and claimed eligibility credits in hopes of obtaining tax returns totaling $848,196. The IRS identified some of the returns as fraudulent and halted some refund payments.
In many cases, the defendant kept as much as half of the refunded amount. Further details have been made available here.
